This document describes how the Sygmare service actually works and is written for transparency, not as legal advice. Sygmare is currently operated as an independent project and is not yet registered as a company, so no trade name, tax identification number or registered address is stated. Those details will be added here once the entity is registered, and the document will be reviewed by a qualified legal professional.
1. What you are purchasing
Sygmare is cloud-based business management software, provided as a service over the internet. A subscription grants a non-exclusive, non-transferable right to access and use the features included in your selected plan during your paid period.
No physical goods are delivered, and no software is licensed for permanent installation on your own servers.
2. Accounts and eligibility
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity carried out through your account and by users you invite. Accounts are intended for business use by adults.
3. Subscription, billing and renewal
- Plans are billed in advance, monthly or yearly, in US dollars (USD).
- A 14-day free trial is available for new accounts. If you do not cancel before the trial ends, the subscription starts and the first payment is charged.
- Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, until cancelled.
- Applicable taxes may be added depending on your location and are shown at checkout.
- Payments will be processed by our payment provider. Card details are handled by the provider and are not stored by Sygmare.
4. Plan changes
You may upgrade or downgrade your plan from your account. Upgrades take effect immediately and the difference is applied to your billing. Downgrades take effect at the start of the next billing period, and features not included in the lower plan stop being available at that point.
5. Cancellation and refunds
You can cancel at any time; cancellation stops future renewals and access continues until the end of the paid period. Refunds are governed by our Refund Policy, and cancellation steps are described in our Cancellation Policy.
6. Acceptable use
You agree not to:
- use the service for unlawful activity or to store unlawful content;
- attempt to access accounts, systems or data that are not yours;
- reverse engineer, copy, resell or sublicense the service except where the law expressly allows it;
- interfere with the availability or integrity of the service, including automated scraping or load that degrades performance for others;
- upload malicious code.
We may suspend accounts that breach these rules, with notice where reasonably possible.
7. Your data and content
You retain ownership of the business data you enter into Sygmare. You grant us the limited right to host and process that data in order to provide the service. You are responsible for having a lawful basis to process any personal data of your own customers that you store in Sygmare. See the Privacy Policy for details.
8. Service limitations
Sygmare is administrative and business management software. It does not provide medical diagnosis, medical advice, legal advice, tax advice or accounting certification. Any reports produced are operational summaries of the data you enter.
The service is provided on an “as is” and “as available” basis. We do not currently publish a contractual uptime guarantee. Planned maintenance and unplanned interruptions may occur.
9. Intellectual property
The Sygmare platform, its software, interface, brand and documentation remain the property of Sygmare and its licensors. Nothing in these terms transfers ownership of the platform to you.
10. Limitation of liability
To the maximum extent permitted by applicable law, our aggregate liability arising out of the service is limited to the amounts you paid for the subscription in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost profits or loss of data caused by factors outside our reasonable control. This limitation applies only as far as the law allows: mandatory consumer and business protections in your country are not affected.
11. Suspension and termination
We may suspend or terminate access for non-payment, breach of these terms, or where required by law. You may stop using the service at any time by cancelling your subscription and deleting your account.
12. Changes to these terms
We may update these terms as the service evolves. Material changes will be announced by email or in the application before they take effect. Continued use after the effective date means you accept the updated terms.
13. Governing law and contact
Sygmare is operated from Peru. Until an operating legal entity is registered and named in these terms, disputes are governed by the mandatory law of your country of residence or establishment, and nothing here removes the rights you have under it.
